THIS CONTEST IS INTENDED FOR PLAY AND PARTICIPATION IN THE UNITED STATES ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO THE LAWS OF THE UNITED STATES. DO NOT ENTER THIS CONTEST UNLESS YOU ARE A LEGAL RESIDENT OF THE FORTY-EIGHT CONTIGUOUS UNITED STATES AND DISTRICT OF COLUMBIA, 18 YEARS OF AGE OR OLDER.

1. Eligibility: Pizza Hut® P’Zone Pizza “Dare You to Still be Hungry” Contest (the “Contest”) is open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia who are at least eighteen (18) years old at the time of entry, who have not been convicted of a felony or otherwise accused of a crime or matter of moral turpitude, who have photo-capturing and uploading capabilities as of June 17, 2007, and who have not previously been, and currently are not, professional/paid competitive eaters. Employees, directors and officers of Pizza Hut, Inc., Zeno Group, imc2, L.P., Yum! Brands, Inc., BBDO Worldwide, Inc., International Federation of Competitive Eating, Inc. a/k/a Major League Eating, ePrize, LLC, and any of their parent, affiliated and subsidiary companies, franchisees, licensees, advertising and promotion agencies, and the immediate families (spouse, parents, siblings and children and their spouses) and household members of each such individual are not eligible. Contest is subject to all applicable federal, state, and local laws and regulations. Void in Alaska, Hawaii and where prohibited by law. Participation constitutes Contestant’s full and unconditional agreement to these Official Rules and Sponsor’s and Administrator’s decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

2. Sponsor: Pizza Hut, Inc., 14841 Dallas Parkway, Dallas, TX 75254. Administrator: ePrize, LLC, One ePrize Drive, Pleasant Ridge, MI 48069.

3. Timing: The Contest begins on June 20, 2007 at 8:00 a.m. Central Time ("CT") and ends on July 1, 2007 at 11:59 p.m. CT (the "Contest Period"). Sponsor's computer is the official time-keeping device for this Contest.

4. How to Enter: During the Contest Period, visit www.pizzahut.com and follow the links and Contest instructions to register for the Contest and to submit a photo of yourself with your favorite P’Zone pizza and in fifty (50) words or less, a description explaining why you should compete in a P’Zone pizza-eating competition against Takeru Kobayashi (“Submission”). By registering and entering a Submission, you agree that your Submission adheres to the Photo Guidelines and Content Restrictions as defined below (collectively, the “Guidelines and Restrictions”) and that Sponsor, in its sole discretion, may remove your Submission if Sponsor believes, in its sole discretion, that your Submission fails to conform to these Guidelines and Restrictions in any way, in which case your Submission shall be disqualified from the Contest.

Photo Guidelines: The Submission must:

  • Display a picture of yourself;
  • Be in .jpg or .gif file format;
  • Be no larger than 300K: and
  • Not have been submitted previously in a Contest of any kind or exhibited or displayed publicly (i.e., disclosed beyond your immediate circle of friends and family) through any means previously.

Content Restrictions: The Submission must not contain material that:

  • Violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  • Includes brand names or trademarks;
  • Includes photos or artwork not created by entrant;
  • Is hateful, tortuous, defamatory, slanderous or libelous;
  • Promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age; or
  • Is unlawful, in violation of or contrary to the laws or regulations in any state or country where the photo is created.

For all Entries: Submissions which are deemed inappropriate, indecent, obscene or disparaging of the Sponsor, as determined by Sponsor in its sole discretion, will be disqualified. Proof of submission or sending is not proof of receipt by Sponsor. All Submissions become the exclusive property of Sponsor and none will be acknowledged or returned. Sponsor shall have the right to edit, adapt and publish any or all of the Submissions, and may use them in any media in association with the Contest without attribution or compensation to the Contestant, his/her successors or assigns, or any other entity unless prohibited by law. Entry of a Submission in this Contest constitutes Contestant’s irrevocable assignment, conveyance, and transference to Sponsor of all right, title, and interest in the Submission, including, without limitation, all copyrights. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, or misdirected Submissions, which are void.

Limit: Each Contestant may enter one (1) Submission during the Contest Period. Multiple Contestants are not permitted to share the same email address. Any attempt by any Contestant to enter more than the stated number of Submissions by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Contestant's Submissions and that Contestant may be disqualified.

5. Winner Determination: Qualified judges will review the Submissions to ensure that they comply with the Submission Guidelines and Restrictions as stated in these Official Rules. Judges will evaluate all eligible Submissions based on the following objective criteria: 34% creativity, 33% originality, and 33% appropriateness with theme (the "Judging Criteria"). In the event of a tie between two (2) or more Submissions, the Contestant whose Submission received a higher creativity score from the Judges will be deemed the winner.

6. Winner Requirements: The potential winner must continue to comply with all terms and conditions of these Official Rules. Winning is contingent upon fulfilling all requirements. The potential winner will be notified by phone, e-mail or mail on or around July 4, 2007. In Sponsor’s sole discretion, the potential winner may be subject to a background check to confirm his/her appropriateness to represent Sponsor in a P’Zone pizza-eating competition against Takeru Kobayashi, and Sponsor reserves the right, in its sole discretion, to disqualify the potential winner based on the results of this background check. The potential winner will be required to sign and return to Sponsor, within twenty-four (24) hours of notification, an Affidavit of Eligibility, Liability & Publicity Release, in order to claim the prize. The potential winner agrees to conduct any and all media interviews arranged by Sponsor related to the Contest and not to disparage the Sponsor prior to, during, or after interviews and not to conduct or participate in any media interview regarding this Contest or Pizza Hut, without the express written permission of Pizza Hut, Inc. If the potential winner cannot be contacted, or fails to sign and return the Affidavit of Eligibility, Liability & Publicity Release within the required time period, potential winner forfeits prize. If the potential winner is disqualified for any reason, an alternate winner will be selected by the Judges based on the Judging Criteria. Only three (3) alternate winners will be determined, after which the prize will remain un-awarded. Acceptance of the prize shall constitute and signify the winner’s agreement and consent that Sponsor may use the winner’s name, city, state, likeness, video, Submission, photos and/or prize information in connection with the Contest worldwide, including the Internet, without limitation and without further payment or consideration, except where prohibited by law.

7. Prize: ONE (1) GRAND PRIZE: A Trip for two (2) to New York, NY for winner to compete in a P’Zone pizza-eating competition against Takeru Kobayashi. Trip package includes roundtrip coach-class air transportation for two (2) from a major airport near winner’s home (determined by Sponsor in its sole discretion) to New York, NY; four (4) days and three (3) nights accommodations at a hotel determined by Sponsor in its sole discretion (single room, double occupancy); entry for winner in a P’Zone pizza-eating competition against Takeru Kobayashi (details of P’Zone pizza-eating competition determined by Sponsor in its sole discretion); and $5,000 spending money. Winner must agree to participate in the P’Zone pizza-eating competition and to travel on dates determined by Sponsor in its sole discretion (during the week of July 8, 2007 to July 15, 2007) or prize will be forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion. If P’Zone pizza-eating competition location is changed for any reason, trip destination may be changed, at Sponsor’s discretion. Trip is subject to availability and blackout dates. Travel must be roundtrip. Sponsor will determine airline and flight itinerary in its sole discretion. No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel and accommodations are subject to availability. Travel is subject to the terms and conditions set forth in this Contest, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, ground transportation, meals, incidentals, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child of winner, travel companion must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner. If winner is a minor in his/her state of residence, travel companion must be winner’s parent/legal guardian. Travel companion must execute liability/publicity releases prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply. If, in the judgment of Sponsor, air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for roundtrip air travel at Sponsor’s sole discretion. Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Sponsor is not responsible if the P’Zone® pizza-eating competition against Takeru Kobayashi is delayed, postponed or cancelled for any reason, in which event that portion of prize will be forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion. Approximate Retail Value: $9,000. Actual value may vary based on airfare fluctuations and distance between departure and destination. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize or a prize component for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use.

8. General Rules: By receipt of any prize, winner hereby waives and releases, and agrees to hold harmless Pizza Hut, Inc., Zeno Group, imc2 L.P., Yum! Brands, Inc., BBDO Worldwide, Inc., ePrize, LLC, and any of their parent, affiliated and subsidiary companies, franchisees, licensees, distributors, advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents, (collectively, the “Released Parties”) from and against any and all rights, claims and causes of action whatsoever that he or she may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death and property, arising in whole or in part, directly or indirectly, from his or her acceptance, possession, use or misuse of the prize, his or her participation in the Contest, his or her participation in any Contest- or prize-related activity, or any travel related to the Contest or any travel for any prize-related activity. Winner also further acknowledges that Released Parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law relative to any prize or this Contest including but not limited to quality, condition or fitness for a particular purpose.

By entering or participating in the Contest, Contestants agree to be bound by these Official Rules and waive any right to claim any ambiguity or error in these Official Rules or the Contest itself. The Released Parties assume no responsibility for electronic hardware, programming or software malfunctions, or failures, or line connections, accessibility or availability, or technical failures of any kind, or unauthorized human intervention, or the incorrect or inaccurate capture of any entry or other information, or for the failure to capture any such information. Sponsor is not responsible for: (1) any incorrect or inaccurate information, whether caused by Contestants, or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; or (4) technical or human error which may occur in the administration of the Contest or the processing of entries. Further, if, for any reason, the Contest is not capable of running as planned by reason of infection by virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of the Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest, and select the winner from the entries received prior to the action taken or in other such manner as deemed fair and appropriate by Sponsor.

Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other promotion, or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Except where prohibited, Contestant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Oakland County, Michigan; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will Contestant be permitted to obtain awards for, and Contestant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Contestant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

10. Winner List: For a Winner List, send a hand-printed, self-addressed, stamped envelope to “Pizza Hut® P’Zone Pizza ‘Dare You to Still be Hungry’ Contest Winner List,” c/o ePrize, LLC, P.O. Box 8070, Royal Oak, MI 48068-8070. Winner List requests must be received by November 1, 2007.
